REGISTRATION PROPOSAL OF MHADA CO-OPERATIVE HOUSING SOCIETY

CHECKLIST
I DOCUMENTS REQUIRED FOR FORMATION OF CO-OPERATIVE HOUSING SOCIETY ON MHADA LAND.
1) Form "A" with statement "A" and statement 'B'
2) Rs. 2/- court fee stamp on Form 'A'
3) 2 copies of bye-laws signed by promoter members.
4) Statement 'C'
5) Scheme of the society.
6) Rs. 2,500/- challan as registeration fees.
7) Bank Balance Certificate.
8) Income Expenditure Statement
9) Letter of Name Reservation of the proposed society.
10) Affidavit by atleast 10 members on Rs. 100/- Stamp paper that they reside within the area of operation of the society.
11) If a firm/company is a promoter member in the society than there letter authorising a person to sign on their behalf.
12) "No Objection Certificate" from concerned MHADA Authority (i.e. Mumbai Housing And Area Development Authority or Konkan Housing And Area Development Authority) about formation of co-operative housing society.
13) Vakalatnama of authority letter of Rs. 100/- stamp paper for appearing on behalf of proposed society.
14) List of flat holders given by concerned MHADA Authority (i.e. Mumbai Housing And Area Development Authority or Konkan Housing And Area Development Authority).
15) Map of plot signed by concerned Executive Engineer of MHADA Authority (i.e. Mumbai Housing And Area Development Authority or Konkan Housing And Area Development Authority) alloted to proposed co-opertive housing society.
16) Whether 60% or more of unit holders have joined the proposal of registration.
17) Notarized Form 'Y' undertaking on Rs. 100/- stamp paper by Chief Promoter.

II - A DOCUMENTS REQUIRED FOR ALL TYPES OF CO-OPERATIVE HOUSING SOCIETY.
1) Form "A" with statement "A" and statement 'B'
2) Rs. 2/- court fee stamp on Form 'A'

14) lf land belongs to a society which already is registered, then NOC by such society for registration of proposed society.
15) 7/12 statement.
16) Whether 60% or more of unit holders have joined the proposal of registration.
17) Agreement of sale between builder and unique purchasers which should be registered and stamp duty paid fully.
    B) DOCUMENTS REQUIRED FOR FLAT OWNERS SOCIETIES WITH BUILDER CO-OPERATION
18) Architect's Certificate specifying details of land and built up area of units.
19) Land title clearance certificate by an Advocate or Solicitor.
20) Building sanctioned plan with date and sanction number oi sanctioning authority attested and signed by Architect.
21) Land Purchase agreement or development agreement.
22) Urban Land Ceiling Act exemption certificate issued by competent authority.
23) Building Occupation Certificate issued by competent authority.
24) Notarized under taking by Chief Promoter on Rs. 20/- Stamp paper in form 'Y'.
25) Builder/Developers to submit list of sold and unsold flats with the stamp of the firm or on their letter head.
26) Notarized undertaking 'Z' on Rs. 20/- Stamp paper by the builder.
    C) ADDITIONAL DOCUMENTS TO BE SUPPLIED FOR REGISTRATION WITHOUT BUILDER'S COOPERATION
In a proposal for registration without Builders cooperation, the Chief Promoter should make all possible efforts to supply documents mentioned in B (18 to 26). If this is not possible the society can be registered without these documents if following documents are orovided.
27) Notarized undertaking on RS. 100/- Stamp paper made by the Chief Promoter instead of the Builder (in lieu of statement 'Z').
28) Notarized undertaking on Rs. 200/- stamp paper signed by All Promoters indeminifying Registrar against any claims suit,damages etc. that may be put forth by the Builder.
29) Proof of payment of Tax to the Municipal or other competent Authority (in lieu of occupation certificate)
    D) DOCUMENTS NECESSARY FOR "OPEN PLOT SOCIETIES".
30) Sale agreement entered into by the land owner and proposed society ofagreement entered into by proposed society and Builder.
31) If land is allotted by Govemment/ CIDCO/ MIDC/ MHADA or any other Corporation, then approved list of members by the authority which has allotted the land.
32) If the Land allotted by Government or if the loan is proposed to be raised for MSCHFC Ltd.; then list of 20% Backward class members.
33) Notarized Form 'X' undertaking by Chief Promoter.
34) Certificate by competent authority that the land is not reserved for public utilities.
